Payment terms

We require a deposit of £100 (one camera kit) or £200 (two camera kits) to secure our services for your chosen date. This is a non-refundable retainer.

Bookings will not be considered ‘confirmed’ until the deposit has been received by us AND the terms/conditions below have been signed and dated to establish a hire and service contract. The contract will be posted to you to be returned to us signed.

The remaining balance of your booking must be paid to us in full three weeks prior to the wedding/event date for the hire and service to go ahead.

 

Hire Period

The hire period will start two days before the wedding/event date and run until the next working day after the wedding/event date (inclusive). We will arrange for delivery and collection of the camera equipment via courier at a pre-communicated time.

 

Service supplied

We agree to hire out one/two Sony 4K camera equipment kits to you for the purpose of filming your wedding/event. A camera equipment kit will consist of: a Sony 4K handycam, a battery, a battery charging cable, an SD card, a zoom microphone and a top light, safely packaged within a camera bag; and a tripod.

We agree to edit the resulting footage into appropriate short film segments and an additional short summary film.

We agree to deliver the edited films to you via an on-line media download site within 12 weeks of the date of the return of the equipment.

The availability of our equipment may be limited and reservations are made on a first come-first served basis and confirmed by the deposit and the signed contract.

 

Status of Responsibility

You become responsible for the camera equipment kit(s) upon handover from our courier to you. We resume responsibility for the camera equipment kit(s) upon handover from you to our courier.

 

Your responsibilities

You agree to examine the contents of the camera equipment kit(s) following handover from our courier and before your wedding/event to ensure that the equipment is in good working order. If there are any technical or operator issues at this point, you agree to raise them with us.

You agree to return the equipment in the same condition as received, ordinary wear and tear accepted. You will not willfully damage the equipment or fail to return it.

Whilst in your care, the camera(s) and equipment must not be left unattended in any unlocked property or vehicle. If locked within a vehicle, due care must be taken to ensure that the equipment is not easily visible.

You are solely responsible for the equipment and those who use it whilst it is in your possession and accept full responsibility for loss, theft or damage to the equipment.

You are solely responsible for ensuring that the cameras are filming throughout the course of the wedding day/event and we cannot be held responsible for any lack of footage, poor quality of filming, or loss of/damage to, memory cards whilst in your possession.

You agree to package the equipment safely in the boxes provided by us prior to collection.

You are not permitted to sub-hire the equipment.

 

Indemnity

You agree to indemnify us and our agents from and against any and all losses, damages, claims, or liability of any kind whatsoever, including legal expenses, arising from the use, condition (including, without limitation, latent or other defects) or operation of the equipment, and by whosoever used or operated the equipment during the hire term. We are not responsible for accident or injury caused directly or indirectly by the use of the camera or equipment.

 

Insurance

The camera(s), and additional equipment within the camera equipment kits, are fully insured by us with a £250 excess.

You may also wish to independently purchase personal Hired Equipment insurance to cover any liability or damage costs incurred over the hire period.

 

The camera equipment kit(s) will be delivered to you in good working condition and any damage, loss or theft of the equipment whilst in your care, will be charged to you. Where the amount of this total charge exceeds £250, an insurance claim will be made by us and you will be responsible for paying the £250 excess charge. You will be liable for the additional costs of replacing the equipment if it is found that your behaviour breached clause 4.1 or 4.2.

You agree to pay any charges to us within 28 days of being invoiced.

In the case of loss, damage or theft of the equipment, you agree to contact us immediately and we cannot be responsible for the resulting lack of footage.

 

Our responsibilities

In the unlikely event that we cannot perform the services agreed upon; all fees paid by you will be refunded. We will take the utmost care with respect to delivery of equipment, editing and delivery of final film footage, but in the event that circumstances arise that are beyond our control our liability is limited. Circumstances beyond our control include, but are not limited to: acts of nature, electrical power failures, strikes, labour disputes, riots, insurrections, civil disturbances, fires, flood, storms, explosions, war and governmental actions, non-performance of third parties, or loss or fluctuations of electrical power.

 

Ownership and Liabilities of film footage

We reserve the right to use any footage for promotional or any other purposes or public display.

The films are produced for your personal, private, in-home use. You assume all liability for any form of copyright infringement and are responsible for any personal releases. Please be aware that copyright infringement for any commercial music featured in the footage/films may be an issue if you are planning to share the films via on-line media sites.

 

Denial of service

Hire and Service will only be confirmed when all agreed pre-payments have been received by us. In the event of any balance remaining outstanding before the date of equipment hire/delivery, all our responsibilities to you are void until full payment has been received.

We reserve the right to refuse our hire service to anyone at any time where we deem it is in our best interest on the basis of credit, past history, lack of safety precaution, or likelihood of abuse or fraudulent hire.

We may also refuse our service at any time, and our obligation under any contract executed will be void, should we discover that the intended use of the equipment presents a serious safety hazard and/or violates any constitutional or by law.

In the event of footage being returned to us which includes content that we deem inappropriate, we reserve the right to refuse to edit this content. This includes, but is not limited to, footage of violence, sexual explicitness or offensive behaviour. Footage of illegal activity may be forwarded to the authorities.

 

Refunds and Cancellations

In the event of a booking cancellation by you, monies paid up until the point of cancellation will be non-refundable. You may request to transfer the cancelled booking, including any outstanding payments, over to a new client/date, which we will accommodate if possible and depending on the availability of cameras.

In the event of any money being taken in error, a full refund will be provided.
